Controller or controller responsible for the processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
Processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
Recipient is a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.
Third party is a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.
Consent of the data subject is any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

Each data subject shall have the right granted by the European legislator to obtain from the controller
restriction of processing where one of the following applies:
The accuracy of the personal data is contested by the data subject, for a period enabling the controller
to verify the accuracy of the personal data.

instead the restriction of their use instead.
The controller no longer needs the personal data for the purposes of the processing, but they are

without hindrance from the controller to which the personal data have been provided, as long as the

is carried out by automated means, as long as the processing is not necessary for the performance of a
task carried out in the public interest or in the exercise of official authority vested in the
controller.
Furthermore, in exercising his or her right to data portability pursuant to Article 20(1) of the GDPR,
the data subject shall have the right to have personal data transmitted directly from one controller to
another, where technically feasible and when doing so does not adversely affect the rights and freedoms
of others.
In order to assert the right to data portability, the data subject may at any time contact any employee
of the DBV electronic GmbH & Co.KG.
Each data subject shall have the right granted by the European legislator to object, on grounds relating
to his or her particular situation, at any time, to processing of personal data concerning him or her,
which is based on point (e) or (f) of Article 6(1) of the GDPR. This also applies to profiling based on
these provisions.
The DBV electronic GmbH & Co.KG shall no longer process the personal data in the event of the objection,
unless we can demonstrate compelling legitimate grounds for the processing which override the interests,
rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.
If the DBV electronic GmbH & Co.KG processes personal data for direct marketing purposes, the data
subject shall have the right to object at any time to processing of personal data concerning him or her
for such marketing. This applies to profiling to the extent that it is related to such direct marketing.
If the data subject objects to the DBV electronic GmbH & Co.KG to the processing for direct marketing
purposes, the DBV electronic GmbH & Co.KG will no longer process the personal data for these purposes.
In addition, the data subject has the right, on grounds relating to his or her particular situation, to
object to processing of personal data concerning him or her by the DBV electronic GmbH & Co.KG for
scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the
GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public

Art. 6(1) lit. a GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. 1. Die folgenden Allgemeinen Geschäftsbedingungen gelten für alle Geschäftsbeziehungen zwischen uns und
dem Kunden. Maßgeblich ist jeweils die zum Zeitpunkt des Vertragsschlusses gültige Fassung.
2. Verbraucher im Sinne dieser Geschäftsbedingungen sind natürliche Personen, mit denen in
Geschäftsbeziehung getreten wird, ohne dass diesen eine gewerbliche oder selbständige berufliche
Tätigkeit zugerechnet werden kann.
Unternehmer im Sinne dieser Geschäftsbedingungen sind natürliche oder juristische Personen oder
rechtsfähige Personengesellschaften, mit denen in Geschäftsbeziehung getreten wird und die in Ausübung
ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handeln.
Kunde im Sinne dieser Geschäftsbedingungen sind sowohl Verbraucher als auch Unternehmer.
3. Abweichende, entgegenstehende oder ergänzende Allgemeine Geschäftsbedingungen werden, selbst bei
Kenntnis, nicht Vertragsbestandteil, es sei denn, ihrer Geltung wird ausdrücklich schriftlich
zugestimmt.
1. Die Konditionen für unsere Waren sind freibleibend und unverbindlich. Unsere Darstellung von Waren im
Internet stellt kein Angebot dar, sondern eine unverbindliche Aufforderung an den Kunden zu bestellen.

Die Entgegennahme einer Phoneischen Bestellung stellt keine verbindliche Annahme unsererseits dar.
3. Wir sind berechtigt, das in der Bestellung liegende Vertragsangebot innerhalb von zwei Wochen
anzunehmen. Bei auf elektronischem Wege bestellter Ware sind wir berechtigt, die Bestellung innerhalb
von drei Werktagen nach Eingang bei uns anzunehmen.
Wir sind berechtigt, die Annahme der Bestellung - etwa nach Prüfung der Bonität des Kunden - abzulehnen.
Wir sind berechtigt, die Bestellung auf eine haushaltsübliche Menge zu begrenzen.
4. Der Vertragsschluss erfolgt unter dem Vorbehalt, im Falle nicht richtiger oder nicht ordnungsgemäßer
Selbstbelieferung, nicht oder nur teilweise zu leisten. Dies gilt nur für den Fall, dass die
Nichtlieferung nicht von uns zu vertreten ist.
Im Falle der Nichtverfügbarkeit oder der nur teilweisen Verfügbarkeit der Ware wird der Kunde
unverzüglich informiert. Die Gegenleistung wird unverzüglich zurückerstattet.
5. Sofern der Kunde die Ware auf elektronischem Wege bestellt, wird der Vertragstext von uns gespeichert
und dem Kunden nebst den rechtswirksam einbezogenen AGB per E-Mail nach Vertragsschluss zugesandt.
1. Bei Verbrauchern behalten wir uns das Eigentum an der Ware bis zur vollständigen Zahlung des
Kaufpreises vor.
Bei Unternehmern behalten wir uns das Eigentum an der Ware bis zur vollständigen Begleichung aller
Forderungen aus einer laufenden Geschäftsbeziehung vor. Wenn der Wert der Vorbehaltsware die zu
sichernden Forderungen aus der laufenden Geschäftsbeziehung um 100 Prozent übersteigt, sind wir zur
Freigabe der Vorbehaltsware auf Verlangen des Unternehmers verpflichtet.
2. Der Kunde ist verpflichtet, die Ware während des Bestehens des Eigentumsvorbehalts pfleglich zu
behandeln. Sofern Wartungs- und Inspektionsarbeiten erforderlich sind, hat der Kunde diese auf eigene
Kosten regelmäßig durchzuführen.
Der Kunde hat uns unverzüglich schriftlich zu unterrichten von allen Zugriffen Dritter auf die Ware,
insbesondere von Zwangsvollstreckungsmaßnahmen, sowie von etwaigen Beschädigungen oder der Vernichtung
der Ware. Einen Besitzwechsel der Ware sowie den eigenen Anschriftenwechsel hat uns der Kunde
unverzüglich anzuzeigen.
Der Kunde hat uns alle Schäden und Kosten zu ersetzen, die durch einen Verstoß gegen diese
Verpflichtungen und durch erforderliche Interventionsmaßnahmen gegen Zugriffe Dritter auf die Ware
entstehen.
3. Wir sind berechtigt, bei vertragswidrigem Verhalten des Kunden, insbesondere bei Zahlungsverzug, vom
Vertrag zurückzutreten und die Ware herauszuverlangen. Daneben sind wir berechtigt, bei Verletzung einer
Pflicht nach Ziffer 2 vom Vertrag zurückzutreten und die Ware herauszuverlangen, wenn uns ein Festhalten
am Vertrag nicht mehr zuzumuten ist.
4. Der Unternehmer ist berechtigt, die Ware im ordentlichen Geschäftsgang weiterzuveräußern. Er tritt
uns bereits jetzt alle Forderungen in Höhe des Rechnungsbetrags ab, die ihm durch die Weiterveräußerung
gegen einen Dritten erwachsen. Wir nehmen die Abtretung an. Nach der Abtretung ist der Unternehmer zur
Einziehung der Forderung ermächtigt.Wir behalten uns vor, die Forderung selbst einzuziehen, sobald der
Unternehmer seinen Zahlungsverpflichtungen nicht ordnungsgemäß nachkommt und in Zahlungsverzug gerät.
Die Be- und Verarbeitung der Ware durch den Unternehmer erfolgt stets im Namen und im Auftrag für uns.
Erfolgt eine Verarbeitung der Ware, so erwerben wir an der neuen Sache das Miteigentum im Verhältnis zum
Wert der von uns gelieferten Ware. Dasselbe gilt, wenn die Ware mit anderen, uns nicht gehörenden
Gegenständen verarbeitet oder vermischt wird.
1. Der Verbraucher hat das Recht, die Ware innerhalb von zwei Wochen nach Eingang zurückzugeben. Das
Rückgaberecht kann nur durch Rücksendung der Ware oder, wenn die Ware nicht als Paket versandt werden
kann, durch Rücknahmeverlangen ausgeübt werden; zur Fristwahrung genügt die rechtzeitige Absendung. Das
Rückgaberecht besteht nicht bei der Übersendung der Ware als Datei auf elektronischem Wege. Daneben
besteht das Widerrufsrecht nicht bei der Lieferung von Waren nach Kundenspezifikationen sowie Audio-
oder Videoaufzeichnungen oder von Software, sofern die gelieferten Datenträger vom Verbraucher
entsiegelt worden sind.
2. Der Verbraucher hat Wertersatz für eine durch die bestimmungsgemäße Ingebrauchnahme der Ware
entstandene Verschlechterung zu leisten. Der Verbraucher darf die Ware vorsichtig und sorgsam prüfen,
wie dies im Ladengeschäft möglich wäre. Den Wertverlust, der durch die über die reine Prüfung
hinausgehende Nutzung dazu führt, dass die Ware nicht mehr als "neu" verkauft werden kann, hat der
Verbraucher zu tragen.
1. Der angebotene Preis ist bindend. Im Preis ist die gesetzliche Umsatzsteuer enthalten.
Beim Versendungskauf versteht sich der Preis zuzüglich einer Versandkostenpauschale in Höhe von € 9,80.
Dem Kunden entstehen bei Bestellung durch Nutzung der Fernkommunikationsmittel keine zusätzlichen
Kosten.
Der Kunde kann den Preis per Nachnahme, Überweisung oder Kreditkarte leisten. Wir behalten uns das Recht
vor, einzelne Zahlungsarten auszuschließen.
2. Der Kunde verpflichtet sich, spätestens innerhalb von zehn Tagen nach Erhalt der Ware den Preis zu
zahlen. Nach Ablauf dieser Frist kommt der Kunde in Zahlungsverzug.
Der Verbraucher hat während des Verzugs die Geldschuld in Höhe von 5 % über dem Basiszinssatz zu
verzinsen.
Der Unternehmer hat während des Verzugs die Geldschuld in Höhe von 8 % über dem Basiszinssatz zu
verzinsen. Gegenüber dem Unternehmer behalten wir uns vor, einen höheren Verzugszinsschaden nachzuweisen

3. Der Kunde hat ein Recht zur Aufrechnung nur, wenn seine Gegenansprüche rechtskräftig festgestellt
wurden oder durch uns anerkannt wurden.
Der Kunde kann ein Zurückbehaltungsrecht nur ausüben, wenn sein Gegenanspruch auf demselben
Vertragsverhältnis beruht.

verkauften Ware auch beim Versendungskauf mit der Übergabe der Ware auf den Verbraucher über.

unverhältnismäßigen Kosten möglich ist und die andere Art der Nacherfüllung ohne erhebliche Nachteile
für den Verbraucher bleibt.
Bei Unternehmern leisten wir für Mängel der Ware zunächst nach unserer Wahl Gewähr durch Nachbesserung
oder Ersatzlieferung.
2. Schlägt die Nacherfüllung fehl, kann der Kunde grundsätzlich nach seiner Wahl Herabsetzung der
Vergütung (Minderung) oder Rückgängigmachung des Vertrags (Rücktritt) sowie Schadenersatz verlangen. Bei
nur geringfügigen Mängeln steht dem Kunden kein Rücktrittsrecht zu. Wählt der Kunde Schadensersatz, so
gelten die Haftungsbeschränkungen gemäß § 8 Ziff. 1 und 2 der AGB.
3. Verbraucher haben uns offensichtliche Mängel der Ware innerhalb von 2 Monaten nach Empfang
schriftlich anzuzeigen; andernfalls ist die Geltendmachung des Gewährleistungsanspruchs ausgeschlossen.
Unternehmer müssen die gelieferte Ware unverzüglich auf Qualitäts- und Mengenabweichungen untersuchen
und uns erkennbare Mängel innerhalb einer Frist von einer Woche ab Empfang der Ware schriftlich
anzeigen; andernfalls ist die Geltendmachung des Gewährleistungsanspruchs ausgeschlossen. Verdeckte
Mängel sind uns innerhalb einer Frist von einer Woche ab Entdeckung schriftlich anzuzeigen. Zur
Fristwahrung genügt die rechtzeitige Absendung. Den Unternehmer trifft die volle Beweislast für
sämtliche Anspruchsvoraussetzungen, insbesondere für den Mangel selbst, für den Zeitpunkt der
Feststellung des Mangels und für die Rechtzeitigkeit der Mängelrüge.
4. Für Verbraucher beträgt die Gewährleistungsfrist zwei Jahre ab Ablieferung der Ware.
Für Unternehmer beträgt die Gewährleistungsfrist ein Jahr ab Ablieferung der Ware.
Bei gebrauchten Sachen beträgt die Gewährleistungsfrist ein Jahr ab Ablieferung der Ware. Die einjährige
Gewährleistungsfrist gilt nicht, wenn uns grobes Verschulden vorwerfbar ist sowie im Falle von uns
zurechenbaren Körper- und Gesundheitsschäden und bei Verlust des Lebens des Kunden. Unsere Haftung nach
dem Produkthaftungsgesetz bleibt hiervon unberührt.
5. Wir geben gegenüber unseren Kunden keine Garantien im Rechtssinne ab. Herstellergarantien bleiben
hiervon unberührt.
1. Bei leicht fahrlässigen Pflichtverletzungen beschränkt sich unsere Haftung sowie die unserer
Erfüllungsgehilfen auf den vorhersehbaren, vertragstypischen, unmittelbaren Durchschnittsschaden.
Bei leicht fahrlässigen Pflichtverletzungen von nicht vertragswesentlichen Pflichten, durch deren
Verletzung die Durchführung des Vertrages nicht gefährdet wird, haften wir sowie unsere
Erfüllungsgehilfen nicht. Die vorstehenden Haftungsbeschränkungen betreffen nicht Ansprüche des Kunden
aus Produkthaftung oder aus Garantie. Weiter gelten die Haftungsbeschränkungen nicht bei uns
zurechenbaren Körper- und Gesundheitsschäden oder bei Verlust des Lebens des Kunden.
2. Wir haften nur für eigene Inhalte auf der Website unseres Online-Shops. Soweit wir mit Links den
Zugang zu anderen Websites ermöglichen, sind wir für die dort enthaltenen fremden Inhalte nicht
